4th amendment, bill of rights. Check it.

You have the right to refuse the search.

being forced to live as a second class citizen in exchange for keeping your rights is not keeping your rights

i.e. you have to vote republican or you can't have a license. it's ok, because you don't HAVE to drive a car...

...right?

This goes against democracy and actually removes a right. Bad example.

removing the right to fly if you don't forfeit a constitutional right is different?

afraid not.

some people's livelihood depends on their ability to fly. my dad's for example.

You don't have a right for being able to fly.

I could say : Taxes are removing my right to be rich.
It's my right to have the freedom to murder someone.

Doesn't work like that.

explain the difference between right to fly and right to drive

your right to swing your fist ends where other mans nose begins etc

driving actually has a lot more restrictions, just none of your civil liberties are violated when you obtain a drivers license or every time you enter your car.

by the way

guess who's caused more deaths

people in cars

or people in airplanes

lol

You do not have the right to drive without a driver liscence. You need to pass exams to obtain a driver liscence.

no constitutional amendment that specifically says you have the right to be exempted from a driving exam

try again

you don't have a right to violate other peoples rights, people have a right to live, you don't have a right to be rich.

however while you don't have a right to fly, all air travel could be discontinued, however you do have a right to not be searched without probable cause/warrant, getting on a plane doesn't justify probable cause.

And you need to afford a plane ticket to fly, your point?

Someone mentioned having to pass an exam to drive.. you don't have to pass anything to ride in a vehicle. I was unsure how we were equating controlling a moving vehicle yourself vs sitting in an airplane..

good point, so do we need to start screening people who get in cars, regardless if they are going to drive? what if the car goes on a populated bridge? and blows up? what then? strip searches when you get in a car?

That's a really stupid argument, you can be able to afford a driver liscence but if you are judged too dangerous or not ready they can refuse giving you the liscence.

you can't equate being a passenger to being a driver, if you want to equate a pilot to a driver then go ahead. Let's say they start strip searching you for taxis?

you have as much right to fly as you do to drive a car

9th/10th amendment etc

if you have conclusively proved you are not a safe passenger, that right can be revoked

just like someone who has repeatedly been convicted of driving under the influence can have their right to drive revoked

however getting your fourth amendment right violated en route to either of these things is unconstitutional

sitting here griping about it doesn't help much

if you are really convinced that it's wrong and you are an american citizen write your congressman

it's not much more difficult than making a forum post

and it's a good deal more productive(i'm still holding out hope, anyway)
