Thing is, they don't have any right to due process just like you have no right to due process. A person must be within US jurisdiction to have Constitutional rights. That depends, seriously it does. Due process exists the moment they are in the USA but it's all about jurisdiction. For criminal matters they certainly have it, in the case of immigration they have the right to have their case reviewed in accordance with the laws and policies set forth by DHS and UCIS. If one of those policies is "failure to apply for asylum at a lawful port of entry within a reasonable time constitutes denial of applicant" then they are still subject to it.

The democrats don't like that the President has control over immigration and are looking for ways to sidestep that control. It's no different then all their other tactics of trying to run the government without being elected to run it.

You will side with them because your of the same religion.

No because they are not ~IN~ the USA.

You must be in a places legal jurisdiction in order for it to apply. The invaders are in Mexico's legal jurisdiction, if they want to file a lawsuit they would need to first enter the USA, then have their case started, then have it adjudicated and then file the lawsuit stating their Constitutional rights were violated. The invaders have not entered the USA, have not filed for asylum, have not been adjudicated and thus have not had their rights violated.

I can't sue you right now for violating my Constitutional rights sometime in the future.

That is why this will be dismissed the moment it's no longer in a liberals hands, maybe even before then cause liberal activist judges can't be too blatant about their prejudice.

I can't find the article anymore on fox news, but I've read the lawsuits are being filled but are not valid until they enter USA.

Doesn't work that way as it violates "good faith". You can't file a lawsuit "in advance" of the event that it claims to have taken place. Courts of thrown out many junk suits for exactly this kind of stuff.

It would be like me filing a law suit today claiming emotional damage after you hit me six months from now.

There was no real concept of legal / illegal immigration back then and this was the first real case about it as the US had just made policies restricting the entry of Chinese immigrants. Back then there was citizen and not-citizen without any real distinction like Legal Permanent Resident / non-Immigrant Worker and so forth.

What you are doing is exactly what the progressives do, taking a 2018 world view to interpret words written over a century ago. Well the 2nd Amendment doesn't say you can have rifles and pistols, it just says arms so it's clearly protecting your right against being dismembered. And even if it is talking about weapons, a knife is a weapon and a person wielding a knife is armed, thus it only protects you owning a knife.

You have it backwards my friend. Progressives argue that arms does and should mean something different today than it did back then. Therefore because the constitution is a livinng document, Its meaning changes with the times.

Constitutionalists argue that the intent of the law when it was written is what takes precedent. Meaning that people are supposed to have equipment to equal military force as it was intended to mean when it was written.

Meanings change over time, intent doesn’t.

We grow them all here in WA. Barley, hops, corn.

Corn is WAY more versatile and adaptable than barley, hops is quite limited.

Corn can be commercially grown in most any state. Barley is grown in the western northern tier states, most of it in Montana and Washington.

74% of the hops in this country are grown in the Yakima valley, most of the rest in nearby WA and OR.
